Is he causing a disturbance now? Do you fear for your life now? If so, call the police station. If not, and he is living with you, but you want him to leave, if the place is yours, issue him an eviction notice.

Well, it's tough, if you asked him and he won't go. Do you anticipate violence? Can you lock him out?
You may just have to move.
