I'm not sure about the regulations, but I would think as long as the foster child has no breathing problems or allergies it would not stop someone from being a foster parent and if there was a regulation about not smoking in the home he could smoke in one room or garage that the child doesn't go into.

Foster (care) Parent laws are different for all states. I am a foster parent and I smoke, my husband doesn't, but I smoke out side. I only smoke 5-6 cigarettes a day, sometimes less, so it isn't a problem for us. I am allowed to smoke in the house or outside with or without kids in my home. The responsible thing to do as foster parents is to not smoke, but if it is not possible for the person to quit then respecting the health of others around you is a must. Check with the Foster Care licensing agency in your county just to make sure.

Good parents have bad habits too. As long as they offer a safe loving environment I think it is fine. Although they may not want to take child with a medical condition (asthma or something) and it is very respectful for the smoker to smoke outside.
