Can a couple claim the telephone tax refund even if they have not filed for income taxes for several years (low income)

Don't need to file a return? You can still request the refund. Use the new Form 1040EZ-T, Request for Refund of Federal Telephone Excise Tax, to choose the standard amount

According to the IRS:

"In general, any individual, business or nonprofit organization that paid the tax for long distance or bundled service billed after Feb. 28, 2003, and before Aug. 1, 2006, is eligible to request the refund."

AND:

"Individual taxpayers can take a standard amount from $30 to $60 based on the number of exemptions they are eligible to claim on their 2006 tax return. For those who can claim:

One exemption, the standard refund amount is $30;
Two exemptions, the standard refund amount is $40;
Three exemptions, the standard refund amount is $50;
Four exemptions or more, the standard refund amount is $60. "


So unless they file a return for 2006, then apparently the answer to your question is "no".

Yes. Download a form 1040EZ-T at irs.gov or pick one up at your local post office or library, and fill it out and send it in. You can only use this form to claim the refund if you do NOT file a federal return.

Yes they can. All they need to do is ask for a 1040 TE form. TE stands for Telephone Excise.
