I think giving it back is the right thing to do.. or you good pawn it off and spend the money on something else and if he asks for it back say you that you already did, tell him he was drunk and wouldn't remember.

The have been several court cases regarding engagement rings. In most cases the courts have viewed an engagement ring as conditional (not a gift) and have ruled that the ex-fiancee return the ring. But there is not specific law that obligates you to return it. It really is a decision you have to make yourself. If he asks you to return it, I think you should, regardless of the reason for the break-up. I actually offered to return my engagement ring to my ex-fiance because I didn't want the memories associated with it.

This has been discussed many times on different court shows. The ring is a gift as a promise to get married. If the marriage doesn't happen, the promise is broken. If he broke up with you, you keep the ring (he broke the promise). If you broke up with him, you give him the ring (you broke the promise).
If by chance that it was some mutual thing, then you two should be able to sit down and discuss the ring. Like sell it and split the $.

Yes, you are - regardless of the reason for the engagement being broken. An engagement ring is not a 'gift' in the usual sense of the word, rather it is a symbol of the promise to be married. This has been proven in the courts.

No. If Her Majesty's Customs and Revenue regards the ring as yours (and if it is remotely expensive it could attract Capital Gains Tax, but I doubt it would be that expensive) the ring is legally yours.
Sorry for being such an accountant!

I don't know if there is any legal obligation, but I believe that an engagement ring is a promise to marry. If you don't marry, you should give it back. If you marry and divorce, you should keep it. I've heard of judges making women give engagement rings back, but he'd have to take you to court to make it happen.
Although, my good friend's thought on that is "Never take it out on the jewelery!" LOL

Yes, especially if it was the ring wearer (usually woman) who initiated the break up.
Even if you're not legally obligated, you're still obligated to return it in the name of personal dignity. It would be really bad form to try to keep it.

I would guess that one is not. If the girl does the break up because this relationship won't work due to personality differences, then, yes, but not obligated legally. I will add that, if the boy is cheating on her, then, he doesn't deserve to have it back.
