Workers Comp all of 2006.
I am divorced.
I had no "earned income to claim on my taxes."
Can I get any $ back? .....and how can I do this when I file.

Worker's Comp isn't taxable if it's paid under a worker's compensation act or a statute in the nature of a worker's compensation act.

If you had no taxable income, you paid no taxes and there's nothing to "get back" as you put it.

If your worker's comp is your only income you do not need to file except possibly to claim the phone tax rebate. That will be $40 for a family of 2. File Form 1040EZ-T to claim the rebate.

Without earned income, you are not eligible for the EIC. Claiming your daughter as a dependent does not depend on the source of income, but you have to provide at least half of her support. Getting a refund depends on how much if any was withheld and if you had a tax liability. Your question does not give the information required to determine if a refund is possible.

Ann S assumes you had taxes withheld. That assumption IS NOT supported by the question.

You can claim her if you and she meet all the requirements, but if your only income was non-taxable workers comp, it won't get you any benefit. And unless you paid something in, there's nothing to get refunded. Workmans comp payments do not make you eligible for EIC.
