I am a college student who is the chief editor of our campus' newspaper. Someone who writes for us (used to write for us), didnt like the way I said something to him and charged at me, smacking a US Constitution out of my hand and yelling and threatening me.

He is not a student, he works at the university.

He is denying what he did, even though people witnessed the ugly incident.

I didnt call the police, even after he verbally threatened me. Now we have to meet with administrators next week. I go to an all black college and am white, and he is also black. I get the feeling they are going to blame me for this.

What should I do? He is a huge guy, and me not big at all. Should I hire a laywer or something? I get the feeling they are all going to side against me, to look out for one of their own.

It was assault. Most people don't know that assault does not even require physical contact. However, unless you can provide witnesses and can also explain why the incident was not reported to the police immediately, it's not likely that a prosecution would be made.

Your first step is not to wait another minute go make a police report and give them your witness information. When you go before the administrators tell them just what happened, and show your police report to them. While you are there get an personal protection order out on him so he cant come within so many feet of you. And rather you are religious or not plz read psalms 91 before going before them. Please don't go looking at it as an Black/White issue go knowing you were done wrong and things will turn out in your favor. I will keep you in my prayers. And by the way I am black.

well first off, why dont u look up in the school reports, this has to come out twice a year at every college, its a report that tells about all the accidents at a college, u can get one from the college office or campus security, u are entitled to view it. see if this has happened to any other minority. they may be trying to get rid of u. maybe it is just a problem with this one guy or maybe the whole university is like that,,but dont point fingers at anyone. u should get yourself a lawyer, it might get ugly.

Tell them the truth.
Why didn't you call the police? Why no reestraining order? Would have made a better case. Now you seem less believable, unless you just want this to blow over.

Line up the witnesses and even have them write out what happened in their own words.

Go right in, tell the truth, present your witnesses, State all the good things you have done in the past and let the chips fall where they may. Only 2 things can happen, 1, you are exonerated and move along with your education as before. 2. You are found guilty and move along to another cllege to finish your education. If they can't see the truth past the color, maybe you shouldn't be there in the first place. Peace

Whether this is assault or any other crime will depend on the laws in your un-named state. In California, this would not likely be assault OR battery as no attempt was apparently made to strike you. For the threats to be criminal they would have to have inferred a physical threat that put you in fear for your safety at that time. However, your delay in reporting it would cast cold water on that theory. The only thing left would be whether or not his actions could be seen as a challenge to fight or words likely to provoke a violent response, in which case he might be able to be charged with a crime for disturbing the peace.

Each state has laws that defines the elements o these offenses. Whether these actions are remotely criminal in your state no one can say without knowing the state you live in.

You might consider speaking to the campus police or to whatever agency enforces the law where this occurred.

Assault is where a person makes you feel threatened of immediate bodily harm, and based on the fact pattern you offer, you were assaulted. You said the police witnessed it, file a report and inform them you would like to press charges. The police are pretty credible witnesses.

File a police report if any of the witnesses are willing to come forward and state they witnessed the incident.

Your fears are well-founded. Talk to an attorney. He may be able to tell you if there is any point in filing assault charges. He may accompany you to your meeting or advise you to stay away if you are outnumbered and feel threatened.

First, file a complaint with the police. Second file a complaint with your dean or faculty advisor. Third file a racial harassment complaint with the appropriate office.
