ith my daughter without her knowing ( my daughter is 5yr) im going thru visitation issue currently can a laywer except the audio and submit it into court as evidence?

Everyone here seems to think you recorded the dad saying something when you actually recorded your daughter saying it. Since you are her parent, I don't see how that would be illegal. Talk to your lawyer. It might not be admissable but I record every minute of my visitation with my daughter so that I can defend myself if my ex ever tries to make any false accusations (she's done this to her family before).

It really depends on how you obtain this evidence. If you take the telephone conversation as an example in some states that would be the illegal if both parties did not know the conversation was taped. In some states it might be acceptable.

Another problem is let's say it's acceptable the judge may only tell your ex-husband to never do it again.... not much of a punishment and now you have exposed how you were able to get this information.... he will be more careful next time.

You will never really know the outcome until you confide in your lawyer. Monitor your daughter carefully when she is around your husband. You never know what he might be thinking, especially since he takes these kind of liberties with her. You know what I'm getting at. Don't let her out of your site!

You can't submit a recording that was obtained illegally. Unless police made it on a warrant or a line trace, or he knew about the recording, it's not legal.Good luck.

It's illegal to tape someone with their knowledge like you did, you broke the law and should be put away.

Her father saying bad things about you isn't against the law, and the court really won't care. Sorry but you have zip. Now your daughter will hold it against him as she grows up, at least you will have that.

you should rally think on that a bit more you might get your self in some trouble and you really don't want to do that if your fight custody on your daughter.

it could be something that the lawyer can use. i hope for your
daughert sake that both of you are not making this a nasty
situation that not good for anyone.
