I am a widow and live completely on my SS widows pension that is a direct deposit to my bank. I am so afraid they will put a lein on my account and I won't have anything to live off of. I do not own anything else. This credit card has not been used since early 2000 and was used most of the time to buy medicines for my husband who is now deceased. I currently do not have a credit card. Please help if you can. I received this summons to answer on 3/20/07.

You definately need to check the collecting SOL for your state.

If you are out of the collecting SOL - file an "affirmative defense of SOL" with your answer.

Call legal aid and ask them to help you write up your response.
If you are past the collecting SOL, be sure to include a counter claim against them for filing on a time barred debt.

Speak to your bank, and not just the person at the counter, make sure they notate on your account that your funds are from SS and cannot be attached.

Bring along with you proof that you're on social security and that your husband is dead and you do not have any means to pay. They may consider this on symphathy grounds and waive the outstanding. However, you did not mentioned your age thus I would suggest that if you're still able to work, get a job and let them know that you're willing to pay by installment when you get a job.

Go to Clark Howard . com website..look for a copy of a "drop dead letter"..7 years is most likely past the time they can collect from you ...but they sell your IOU to a scavenger for ten cents on the dollar..and the scavenger tries to scare you into paying even though it is not legal...the letter will tell them that you don't owe the money and don't contact me again. Don't talk to them on the phone. Good Luck

It is my understand that social security income can not be attached. Although this is just hearsay on my part.
