I've been told that a settlement is usually 3 times the amount of your total medical bills. When I was in an accident, that's about what I received. But, if you hire an attorney, they will get a good portion of that money. I think you can negotiate with the insurance company yourself and hold out for that amount.

The insurance policy is intended to cover your losses, not to make you a millionaire. Add up the unpaid time you lost from work, your medical costs not covered by insurance, any legal fees, any misc. expenses for having the car towed and disposed of, using a taxi or bus to get around until you got a new car, and a small amount for pain and suffering, and you'll have some idea of what to expect.

depends on what the driver that hit you had from medical liability...if the min. i believe its like 10, 000.....i could be wrong though...but it does depend on the drivers insurance.
I hope you created a report with that agency, they usually deny claims after a year of the accident.
If it was more than a year, you may be able to win in small claims for medical bills, and possibly future physical therapy.

no insurance go right to small claims for the medical bills and physical therapy. Get letter from your doctors on how the injury will affect your life, and what care you will need from on.\

Sorry to tell you this, but if the other driver was at fault, and had no insurance, you will get nothing from your insurance company. Your claim is against the other driver. If he has no coverage, he probably has no assets either. the best you will do is get a lien on him, should he ever have assets, but no atty is going to take that case on contingency, and would charge you $2-4000 upfront.
Youre screwed im afraid.

If the other driver did not have insurance, you have to carry uninsured motorist coverage. Then you have to sue your own insurance company to pay you. A lawyer won't bother going after an individual, because they won't be able to collect any money. They are only interested in their bottom line.
It's not a bad injury, it may not be worth pursuing. You can talk with a personal injury lawyer. They consult for free.
