Both parents have equal right under the law, however since you are not married you will legally need to establish paternity (easily done with DNA test). You can sign voluntary establishment of paternity documents at most hospitals, birth registries or petition the court to establish paternity or have it done at the local US state government agency after the baby is born.

Custody can then be established by the courts. it is best to have an attorney help you do this. It is unlikely that a father would be given "full" custody of a newborn unless he can prove the mother is "unfit" and yourself "fit". You will have to be able to legally prove unfit, not an easy to do. Keeping both parents involved in a child life is the starting point due to it usually being in the child's best interest. A better route might be to petition the court for shared custody, this can be a split of 50-50 , 70-30.... whatever can be worked out between the parents.

Get a lawyer. If the mother does not want or knows she cannot take care of the baby, or for any reason is not the suitable custodian, try to negotiate a custody agreement(through lawyers on both sides), and enter into a written agreement.

If you and the mother cannot agree, you would have to prove she is an unfit mother in a court proceeding. Probably a very nasty way to proceed, very expensive, and quite an uphill battle. Additionally, the child is going to love both his/her parents, and to enter the world with this kind of rancor already existing between his/her parents is obviously destructive.

Try to rach an amicable agreement about custody. This is almost always better than a court decree. And if you are able to agree on custody at the outset, there is an excellent chance that you could agree on any future changes that might be necessitated by "change of circumstances". Life on both sides will have its ups and downs.

The "Best Interests" of the child must be the paramount concern of both parents, and not their subjective needs and desires.

Why in the hell would you want to go after custody while she still pregnant, The baby not even here yet and you are already fighting over custody, Give me a break pleaseeee, First of all if you care about your unborn baby you would leave the custody battle alone till after the birth , to give your ex a chance of delivering a health baby. why put all this stress on her while she is pregnant, do you not know that pregnancy itself can be a very stressful time. Putting all this stress on your unborn child is so unhealthy and can cause her to go into early labor. Go take a 3months vacations and relax yourself and worry about this after the baby born.

U first have too get DNA saying u are the father, after that it's going too be very hard too get full custody, Your best bet is to go through the justice system and be the best father u can be. Even if u don't get custody of your child please keep in mind that for the next 18yrs. u & the mother are going too have too communicate and be civil for the childs sake. Good Luck & Cong. on fatherhood.

Before the child born, you can do nothing.Because you both are not married, you have no right to claim other people's unborn child. If she is not willing to give this child to you (full custody) only hope you have is go to court.First prove your relationship to this woman, then prove you are the father of this child then prove this woman is not fit to be a mother(even though,if her relatives chanege you, you still may not get this child).the other side effect of this action is if you failure to get full custody then you will have to pay the child support until this child 18 years old.the amount of child support is as high as 18% of your total income.

depends on what state or country you live in. Is she on any government assistance? If she is they will since you weren't married make you sign a documnet that the baby is yours or you'll do a blood test. If she is on any assistnace than they will set up a child support order against you. Than you can state your case. Is she doing bad things? is she stable? Can she afford or take care of the baby? Its hard to do if she isnt doing anything wrong. If both of you are fit than you'd have to fight for 50%. Good Luck. You can call a free legal aide service for questions too!!!

Go to your local family court And file a petition as soon
as the baby is born. But you must sign the baby's birth
certificate giving her your last name. You must show
proof to the court as to why you want custody. Wether is
because she is an unfit mother or uses drugs, etc. Request
legal advise & representation at the court.

You have to prove that she is an unfit mother and a danger to the child.
