i just wanted to know how much money i would get for pain and suffering my daughter daughter is 13 and we were in a car accident she has been going to a chiropractor and we are almost done in mass we have up to 2000.00 dollars to go up to but she still is having trouble with her back she is a cheerleader and a captain this year. i feel so bad for her and also everytime i drive she has a hard time because she thinks she is going to get into another accident the accident took place on 10/10/06. and she was taken away in an ambulance. i need advice please help i do have an attorney how much can i get for pain and suffering with my daughter

dont settle for 2 years as the pain is still there this is a time for a lawyer get her well first thain get the cash

Based on the information you provided, you don't get compensated for being in an accident. You get compensated for the injuries. I don't know about MA but if you have a verbal threshold policy and were not hit by a commercial vehicle, you would have to prove a significant injury, such as a disc herniation. Bulges don't qualify. If your daughter is traumatized, then she would've consulted with a Psychologist. Not trying to be mean. You would need an expert to testify that her injuries were serious, if you go to trial.

Secondly, if your daughter is a cheerleader and a captain, I will have to assume she is not seriously injured. I don't know if your attorney has told you, but when you are trying to sue an insurance company, this is one thing you shouldn't be disclosing, b/c if I was an adjuster I would think she's not injured at all. As you are aware, cheerleading is a very technical sport, there's a lot of intense jumps, stunts, and moves.

Lastly, you will not recover anything. If your daughter gets awarded more than $5,000.00, then her money gets put away in a trust fund until she's 18. If its under $5,000.00, then you get her check.
