Certainly any accused can be discharged even at pre-charge stage if the court is satisfied that there is no sufficient evidence against him that can incriminate him,make him labile for any punishment for the offence the complaint is made. In the eye of law every one is Innocent until proved to be guilty. This is the basic principle which is followed by the courts in India for meeting the ends of justice.

Yes as per law accused may be discharged at the time of framing charges.There is a remedy for innocent people in Indian penal code.
