Well, considering the insurance for the car excludes test drives, that guys insurance won't pay.

RE :Car accident in California with no insurance. What do do now?
A friend of mine just got into a car accident in California. He was test driving a car. The guy who wants to sell the car was in the passenger seat. My friend was unfamiliar with the area and the guy who wants to sell the car told him to turn right. While doing that he crossed another lane and got hit by a car driving there. Both cars got quite damaged, but no one got injured. Police came and filed a ticket against my friend. He does not have any insurance. What advise could I give him? What should he do next?
I don't live in the states so it is kind of hard for me to help him.

He will likely lose his driver license, be sued by the seller of the car, and the other driver. The seller will probably use his insurance to cover his repairs, the insurance company will come after your friend. The money he can't get through insurance, the seller will file a civil suit against your friend. He better get an attorney, and he better start saving some cash, it's gonna cost him. He should never have just changed lanes without checking to see that the lane of travel was clear. Regardless of what the seller said, the driver is the responsible party, he is the one with is foot on the gas.To say or imply that, since the passenger told him to change lanes, that he is not liable, is wrong.

I guess your friend does not know how to drive too well. I always tell everyone, that is what you get for driving without insurance.
Basically, I would think the owner would be responsible since it is his car. That is if he was in Texas. In Cali, I do not know. I know he will have to pay the ticket and possibly "Forced" to get insurance at a higher rate.
Your question sounds like you got in the accident and then try to pose the question for your "supposed friend." Anyway, you can read the URL and read it yourself.

the car owner may be liable on his insurance policy since he invited your friend to do the test drive and I assume did not say anything about insurance .
he should probably speak to a lawyer before making any admissions of liability or making any offers to pay for damages.
