Deal with all the problems that caused you to lose custody in the first place. Tell your mother that you plan to regain custody of your son and that you plan to do what it takes. And be the very best dad you can be to your son under the circumstances. This can win your mother over and maybe she will voluntarily turn him back over to you. Good luck.

Well, obviously, you would have to bring it through the curt systems. Go to your local childrens and families office, and they will hook you up. Make sure that you could not be proven to be an unfit parent, though. In other words, no drugs (because you will be tested before awarded custody), no excessive drinking problem, nothing in your home that could be proven harmful to the child, and make sure that your income will support him, once he is in your custody, otherwise, you will be going through this battle again before you know it.

Please please do not give up. My mother got custody of my two children and I never got them back. Get legal help immediatly. And make sure your attorney is for you. Find out what your state requires of you to get your child back and then do it to the letter. Make sure your home is clean and ready for your son to walk in the door like it is home. Make arrangement's to cover very thing possible you can think of. Example he forgets his key, and you are at work. Names and numbers of who to call. No matter how hard it looks do not give up and don't stop. I also suggest you keep a journal of everyone you talk to, and what they tell you. And pray!
