Ofcourse it is. But how are you going to prove it in court?
The problem is that women are so much more fragile than men and are afraid of getting hurt if they don't give in to the guy after they say no and he is refusing to stop.
Implied consent is assumed if you don't fight and then it is harder to proof in court that you were raped.
So a good idea I think would be to struggle and refuse until the guy stops. If he hits you even better for you. Every bruise you get will be another evidence that he forced himself upon you. The bruises will heal and plastic surgery can fix almost everything, and in some cases can make you look even better than before. Plus he will be paying for everything and more once convicted. The emotional bruises on the other hand will never heal if you get raped.
If things escalate to the point where you believe that he is going to kill you then it's definitely time for gauging out the eyes.
Gauging out somebody's eyes is alot harder than you might think though. Try closing your eyes and squinting your eyelids together as hard as possible. Then try digging your fingers into your eyes. It's amazing how much pressure they can actually take! If you have nails then they would scratch his eyelids, but I don't think any nails are sharp enough to penetrate through tightly squinted eyelids. Now try moving your head around while your are pushing on your eye. It's almost impossible for your finger to get a good grip let alone dig into that spot on the sides of the eyes where you actually have to press in order to pop an eye out.
So you would first have to grab his head with one arm and put him into a head lock squishing his face to your bosom (which might be confused with an act of consent) so his head can't move around before you try to poke out the eyes.
I don't know, this is just what I would do if I was a woman. Because I definitely would not want to do the other thing that statistically helps women escape rape successfully. Which is to poop and pee and smear it all over yourself, hair and into the attackers mouth and yours.
I'm so happy I'm not a woman and don't have to worry about these things!!!! :)
I know I went off the path, but this answer was more for other women who randomly clicked on this "RAPE???is it?" link.

Rape is unlaful carnal knowlegde of a woman , the crime is completed once there s penetraion and the lady did not consent to the act.
The guy can get off he charge by showing there was consent.
Consent does not always have to be actual. Since you said they were messin around each other, there is an implied consent...... he consent could however be deniedif thelady hd put up a fight.
In your question it sounded like the lady settled down to enjoy it.

If you change your mind and the other person continues it could be considered rape. But you have left a lot of facts out of your question. Were you clothed, were you already engaged in sex? Anyway No means No. Even if you were engaged in sex, if you said no the other party should have stopped.

It depends on what you mena by "messin" and what exactly they did. But regardless, no means no. If you feel that something needs to be reported, go to the police and they will tell you if something illegal took place.
