we are only 3 out of 5 children are living, but these two brothers we already loss have left children behind. how would it be the said money divided by law?

How about morally?

Why not give the children of the deceased brothers their share, had they lived.
Would the 3 survivors starve? Geeze!

The law would not require this.
I'm surprised that it was not addressed in the will or beneficiaries on the insurance policy.

Depends on what state you live in, and who the settlement is for - if it was for the brothers, only their children & spouses will likely get any. If it is for parents, then it might go to all five children, the two brothers shares being passed down to THEIR estate, or it might to to surviving children.

It completely depends on how the beneficiary clause reads. It could be divided among only the living children or it could be split among all the children with the heirs of the deceased siblings getting their portion.

This can only be answered by an estate attorney. These laws are extremely complicated and vary from state to state.
