This afternoon while driving. another car going in the opposite direction crossed over the double yellow line, around a blind curve (to pass someone) and almost hit my car head on. I was able to turn into a ditch at the side of the road just in the nick of time. His car hit mine on the left side. He drove away, leaving his side view mirrow on the ground, The lady he was passing saw the whole thing, and told me that she would get his lic plate # and call the cops. Cops came to the side of the road where it happened- minimal damage done to my car. They found the guy, and the cop just called me to say that he was issued several summons, and asked if I will testify. I said yes but, I have
A few questions- Will the guy have to know my name and address? We live in the same town and I don't want him coming after me.
What will happen to him? Jail? suspended licence? Nothing?
I am just in shock that my 4 year old daughter and I could have been killed.

Thank you for your answers. I've actually never seen Law and Order. I do have Post Tramatic Stress Disorder from a violent mugging 2 years ago, so perhaps that is why I am so afraid.

The guy won't come after you, it's his own stupid fault for passing in an area where he shouldn't have been. I doubt he'll get jail time though. Depends how his driving record is. Tell the judge you were scared for your and your daughter's lives.

I am not a lawyer, this is simply my opinion.

I can only answer for Fla but you would be legally bound to exchange information. I understand your fears. If all you care about it is the repair of your car and the coverage of injuries perhaps you can find out from your ins company if he is covered. You are not under any compusion to testify. Let the reporting officer know you are having second thoughts and save everyone some time and money by cancelling his court dates. All except the violation of right of way that caused the accident. I'm not a lawyer, especially in your state, so this is just friendly advice, not legal advice. There is no telling what sentence he would get but the worse of a person he is the more you would probably be concerned if he was punished by the court. Do everything appropriate to protect you and your family.

He will come after you and then what? Comon, sit up straight. You've been watching too many reruns of Law and Order on TNT.
