My boyfriend's status as an F-1 student is in severe jeopardy. He failed to extend his I-20 in a proper time frame (since December) and therefore, he is currently out-of-status. He only has one class left in order to graduate and obtain his bachelor's degree. I'm not sure why he neglected to file the necessary paperwork to extend his stay here in the U.S. For the past two months I've encouraged him to file a reinstatement letter with the help of his school and a lawyer. Unfortunately, he is depressed and believes that the reinstatement process will not amount to anything. He has missed class. To this day, has not filed his reinstatement letter. He told me that he doesn't even want to graduate. He thinks the solution to helping him stay here in the country is to marry him, but I know that I'm not ready (financially, emotionally, etc). I want to help him, but I feel so much pressure. It hurts me to see him not do anything to help fix his immigration status and to graduate from school.

Your boyfriend's status is not in jeopardy, it does not exist - his I-20 is expired and he has failed to attend class. At this point, the smartest thing for him to do is to talk to his Designated School Official (DSO) and request a new I-20 from the school, then return to his own country and re-apply for a new F-1 visa. The length of time he has been out of status has not quite reached a critical point, so getting another visa is not out of the question. However, if he continues to linger in the US while out of status, he will very likely be arrested, detained and then deported, which will make it very difficult for him to return, in any capacity, in the future.

First allow me to say am sorry you are in this predicament - I can say that you must really care for this guy to take time to find out about this. As you mentioned before, you are not ready to get married and you should not enter into it in any way. Do not let him coax you into it, it'll only bring heartache in the end.

Secondly when he applied for his visa, he knew the consequences of being out of status. He should have taken the initiative to correct his status instead of assuming he'd depend on someone to help him out because he was not willing to get off his lazy behind and take care of things himself.

My thought is that the expense of having to go to a lawyer and file the paperwork is what he doesn't want to deal with. Plus he probably doesn't want to do it because that might mean that he might have to go back to his country. If he has been in school w/o ever being out of status, his school can help him get the status corrected.

All in all - whatever you do, do not marry the guy. If that is what he insists on - then say NO, marriage is a biog step and should be entered in when both people truly love each other and want to spend the rest of their lives together - not for stuff like this.

It doesn't sound like he is trying very hard to help himself so I wouldn't worry about it too much if I were you. It is his own fault and he seems to be unwilling to try and solve the problem. Don't marry him if you aren't ready. That is really selfish of him to suggest when he hasn't even tried to help himself. Talk to him and tell him that the only way you can be together is if he files this letter. If that is not enough to get him going then he probably isn't worth the trouble.

Actually that is the only way to help him, but question is why are you not ready to marry him? If your love is true and you really do want him to stay, you should marry him. Love needs sacrifices. Sacrifice you everything for him. Be a good girl and do not let get your love lost. I love people in love. that is why I am extending my advice.

You will repent after wards.

Sounds like he is discouraged at the fact that there are millions of illegal aliens here making a living and he has to go through so much. Geese, I'm going to claim myself an alien so I wont have to pay all those taxes and get free services.... Other than that, I think he is trying to manipulate you to marry him... DONT FALL FOR IT BABE!

If he wanted it bad enough he would have complied with the rules. They were not that difficult. He will have to go back to whatever country he came from and start the process all over again...Just say good bye and start your life with a law abiding citizen.

Dont marry him just so he can stay in your country would be wrong on so many levels, if he cant help himself then maybe its time to dump him and send him home, harsh maybe but it might give him the wake up call he needs!
