I was getting a divorce last year and was wanting to know what status ti file under. The divorce wasnt final until January of this year. We were apart almost the whole year. Should I file single or Married filing separately. Please let me know. Thanks.

You have to file Married Filing Joint or Married Filing Separate. If you took care of a child or other qualifying relative you may be able to file Head of Household. You can not file as single because you were married on the last day of 2006.

Your filing status is determined on the last day of the year. If you were not divorced until 2007, then you file married for 2006.
The exception to this is if you have a LEGAL separation. If you have a "Separate Maintenance Decree" that is legally filed in court & signed by a judge, then you can file something besides married.

If you weren't actually divorced until 2007, then you can't file as single for 2006. If you didn't live with your spouse at any time during the second half of the year, AND you had a dependent child living with you, you can probably file as head of household - otherwise, file as married filing separately.

If you and your ex can agree to do so, you could also file a joint return for 2006.

Your only choices are Married Filing Jointly or Married Filing Separately.

Check your divorce decree. It may well order you to file a joint return with your ex and split the refund. That's very common language.

If you were separated for more than six months, then you may file as single. If you have dependents living with you, you may file as head of household.
