I have gucci purse which is fake, If i sell the purse as fake will i still be breaking UK law.

Thanks for you help, I decided to ring trading standards. They said providing i clearly state that the purse is not a real gucci and cant provide authenticity i can sell it on...

I know ebay regualtions and didnt plan to sell on ebay. Ebay allows no fake goods even if you say there fake..

Thanks for all your help , is hard to choose the best answer but will do the first one who replyed with correct answer

An unlicensed item is illegal regardless of whether or not you admit it.

It is NOT legal for it to exist, and so therefore there is no way it can be legal for ANYONE to sell it. For ANY reason. Under ANY circumstances.

Does this mean you will be arrested? Not necessarily, but as you asked it if is legal or not to re-sell it, the answer is simply no, it is not.

The law is not specifically a UK law - it is part of the ICC (international commercial code) where all member countries agree to honour and protect the property rights of legitimate owners of trademarks or copyrights against abuse within their jurisdiction.

No, you can't. Ebay has a restriction against listing unauthorized replicas, like a fake gucci purse.

This is from ebays site:
Counterfeits, unauthorized replicas, unauthorized items (such as counterfeit watches, handbags, or other accessories) or unauthorized copies (such as copies of software programs, video games, music albums, movies, television programs, or photographs) are not permitted on eBay. Unauthorized copies include (but are not limited to) copies that are pirated, duplicated, backed-up or bootlegged. It is illegal to sell unauthorized copies of media.

You have to clearly state that it is not a real gucci purse and make sure that the buyer knows that so has no comeback to try and sue you etc.

It would be breaking all sorts of trademark and copyright laws particularly if it displays the Gucci logo anywhere on it.

So yes, given that, you would be breaking the law.

Perhaps you should look into where the proceeds of your money went when you purchased your cheap counterfeit handbag.... drugs? child sex slave trafficking? the list is endless... so think on next time you decide to indulge your pointless purchase.

I think you can sell it if you state it is fake. But Gucci have the right to tell you that you cannot sell the item.

If you sell it as a fake i dont think you are breaking the law then but if you try and pass it off as gen. yes could be trouble

My mother-in-law was kicked off of ebay for selling knock off louis vuitton. She stated clearly they were knock offs. Still she got booted off.

It will be illegal because the design of the purse will be patented by gucci and you will be technically making money by ripping off their design.

You can sell or do what ever you want with it as it is yours. What you must not do is to pass it off as a genuine Gucci. If you do it is fraud and misrepresentation.

as long as you make it perfectly clear to anybody who is interested in it that it is a copy and not the genuine article then you are quite safe to sell it on.
