My daughter was with a friend who squirted washable window paint on the window of a car belonging to a girl who was in a fight with my daughter. The owner of the car(we are not sure of ownership) or her friend called and made a police report. Later that nite these girls called my daughter to meet them so they could talk. My daughter did not go alone or meet them in a private place. Good thing too because one of them stabbed her in the face. now that is just to give the highlights of the story. The detective in the stabbing case called my daughter and told her that if she wanted to pursue charges on the assult that she would be chgd with criminal vandalism. That did not sound right to me. #1 the total damage to the car is a $5.00 carwash #2 she is not the one who squirted the paint #3 how does one case have anything to do with the other. If anyone knows AZ laws on vandalism please respond. she works w/special needs ppl and would lose her job if she was convicted of a crime

Based on what you have stated, there are two separate cases here. One for criminal damage to property and one for aggravated battery. The incidents happened at different times at different locations. Your daughter shouldn't be charged with CDTP as she is not the one that actually did it unless she asked her friend to do it for her. More than likely, the county attorney won't even take the CDTP case as it is very minor. The agg battery should be prosecuted to the fullest extent. Without all of the details, though, it's hard to give you an exact answer on this. Either way, your daughter needs to pursue the agg battery charges.

I won't pretend to know AZ law but, Criminal vandalism sounds a little strong. Your daughter is probably just as guilty of the vandalism as the girl that did it. guilt by association. She may be able to beat the rap, but who knows, she did have the paint with them and that may go against her.
The other girl stabbed your daughter, I would file a police report and charge her with attempted murder. Don't let her get away this. The next kid may die.
I have a feeling that this other girl is not a stranger to the legal system. The cop may have been a friend of her family, or a relative, or even a friend of her lawyer.
Get down to the station today and swear out a warrant for her arrest.

I am not all that sure of AZ law but, If what you are saying is true, the most your daughter can be charged with is a misdemeanor vandalism. Small fine and restitution. The detective sounds like he simply didn't want to do his job and used the charge to scare off your daughter. Two things you can do. One talk to the detective supervisor and/or talk to the District Attorney or County Prosecutor (which ever has jurisdiction).
