i had a accident while reversing the rental car.No third party is involved. Now the owner is chargin me the damages$450..lost of income $250- which is fair 2 me but on top of dat he claiming $500 Excess insurance claims from me??!! shld i Pay the $500? HELP ME.. :(

First you need to read your rental contract and what it says about damage claims and insurance. If you have an insurance policy in the state I'd read it over as well. You are probably only required to pay actual cash value, which means if it is a 2000 XYZ car, you only owe for a used 2000 bumper, not a new bumper. He is basically getting put back in the same position since it is a bumper and with paint it will match. He is getting loss of business reimbursement. but I can't see any other sort of loss of use he could claim.

I'd then call the Insurance Department for your the state and find out what you owe. Then I'd call him and have him explain the $500 charge, I'd tape record the call even if it is not allowed in court. (He may file a claim under his companies insurance policy and want you to pay for his increased premium) Usually, not allowed in most states and generally considered insurance fraud.

When you show up with the check, bring a form that says you are paying $$$ in full for all damages and he agrees there will be no further claims for damage resulting from the accident on X date to Y car, etc. You can probably find a MUTUAL RELEASE form on the Internet or in a office supply store. He does not get the check until he signs the form!!!

If he really becomes an ***, file under your own policy and let them fight it out.

Yes to the first two. Hell no to the last one.. File with your own insurance company, and your liability will take care of it.. As long as the damages are less than 1,000 you should be ok as far as your rates going up... I wouldn't recommend settling with the other person out of pocket, cause they can always come back to claim more damages..

That third one sounds like BS. I'd ask them to explain that line. It sounds like they got an increase in insurance premium and they're passing it onto you, which is BS, since you're paying.
