I was driving on an open 4 lane highway, the speed limit was 55. I was in the fast lane going 45-50, with no cars in front, behind, or beside me. A 1970's Chevy truck came up behind me and got within 2 feet of me. He had no reason to be on me, as he could have passed. I tapped my brakes and he got closer, so i hit my brakes hard and he had to swerve. He lost controll and ended up backwards on the highway. Is this my fault, or is he just a jackass who deserved it? He didnt crash, just spun around.


I didnt stop to see if he was ok, because im sure he would have been pissed off. I saw him later on down the road, he was looking in the bed of his truck, so he must have been ok.

I was in the left lane because i had to make a left turn within 1/4 mile.

I would have done the same thing, I hate when people ride my ***. I think he was just a jackass and deserved it....luckily he didnt crash, ud have that on ur concience.... But Id lay low for the next couple of days, maybe he was looking in the back of the truck for his shotgun! just kiddin.

Depending on how u look at the situation, You may or may not be at fault... He was tailing you, or, following too closely. There should be a distance between two cars long enough for the one behind to stop or slow down if necessary. Yes, u could have just moved over, or sped up, or maintained speed and hoped he moved, but if there were 3 open lanes, he should have moved. Ive dealt with an accident like this, and my client was not at fault. The other driver was ticketed for "following too closely"

Yes it is your fault. Most states have laws stating unless you are passing a vehicle you must stay/drive in the right lane only. If you were in the far left lane (The Fast lane) going slower than the speed limit and you deliberately brake checked someone for tailgating it is your fault and you could be charged with Reckless Driving. If someone is tailgating you and you have room to get over to another lane you must do so, causing an accident is a sure fire way to not only get your license revoked or suspended, but will definitely raise your insurance rates.

no, you are not at fault. Yes, there are minimum speed limit laws.. but they are never only 10 mph under the limit. He was following too closely and should have had enough distance to be prepared for a situation such as you applying brakes. Maybe he will think twice before tailgating next time.. but i am glad he wasnt hurt.

Yes, you would be at fault for the accident. You were braking hard when you knew there was someone to close behind you. You were trying to cause an accident. You would have been 100% at fault for this accident.
