I'm not sure what 18 USC 2441 is, but after you're attacked and a war is started, the president and his crew have more powers than in peace time. If he were doing this stuff and 9/11 hadn't happened then he'd be in real hot water, but after the event in New York, he can do whatever is deemed necessary to defend the US.
