I haven't paid for over 7 yrs,the debts have gone to collection agencies and about once a year I'll get a letter from whoever has my debt now and they try to intimidate me but I have a po box so they can't serve me.

Yes, there is a Statue of Limitations (SOL), it is from the date of first missed paymnet on your credit card or charge account. So for me, my SOL in Hawaii is 6 years from the first missed payment, Many are somewhere between three and six years. Do a Yahoo search for Statue of Limitations, there are alot of great resources out there, including Credit Info Center and Fair Debt Collection that have SO much info!

As far as what I am reading here, activity on your acct does not mean then sending you a letter.

It sounds like collections agencies have violated the The Fair Debt Collection Practices Act by harassing you.

They will keep trying to collect as long as possible. It's just that the credit card company cannot sue you any longer.

The statue of limitation is from the date of the last demand letter sent to you. just because it is a PO box and that you are not available to be serve with the writ of summons does not mean that the time stops. It would be from the date of the last posting to the PO box and then you count 7 years friend.

perhaps you should rethink your strategy.

Depending on your state, the statute of limitations on open-ended accounts (credit cards) varies from 3-8 years.

You might be asking yourself, "It has been such a long time since my credit card has had any activity. When did my Statute of Limitations started ticking." Use your credit report as a reference. Your credit report will tell you the date of last activity for your account. You will have your credit report with the date of last activity and a certified letter stating that the statute of limitations expired.

You are out of luck.

As long as they keep generating a report and letter that shows that you still owe the debt, then you are still on the hook for it. The 7 year statute of limitations is only for when they have not taken any actions in that period of time. Mailing you a statement every year is their "action".
