knocking or anything, i had a policeman come in my home one saturday because supposingly a person down the street from where i live was beat up by a ex husband, the thing is me my daughter and granddaughter and husband and my son were home and out in the yard with my granddaughter and we just left my son outside with my grandaughter he was watching her play a little longer and my street has about 10 houses on it and i pretty much know everyone on the street and we did not see any police activity on the block and we were out there for about 2 3 hours well i was in my room talking to my husband and i look out my bedroom door and i see a officer standing all cool in my living room i did not rush to the door due to where im from they like to pull the trigger i asked can i help you and he started rambleing about some name down the street etc i just looked at him and said i had no idea what you are talking about i want to know why they can walk in like they live there i feel unsafe

my son was at the door hands up my grand baby was wondering whats going on and i had just been outside as well for about a hour 1/2 and no police activity oen or up the street my son said they did not ask if they could go in one had him the other did as pleased. i lived there for 4 years and know everyone on the street i think it was a excuse because my son is latino and they saw him sitting by himself my son is hardly a gang member he works for the calif forestry dpt. i asked neighbors and they said the person they claim was beaten in the hood dose not exist i sad to say there is more coruption in the city police then sherriff or other law enforcement that has to answer to the government more directly the city pds are more privately run and this is in colton ca

Not unless they believe someone is in presently in danger and being held against their will. There may be other circumstances as well that depend upon where you live. I would seriously look into it especially living somewhere where they are likely to pull the trigger. I wouldn't start at my local precinct though, contact you state attorney's office for guidance.

I would ask the kids befor you do anything if you plan to do anything because they may have told him to come in or even held the door open for him which is an implied invitation.

Actually there are a number of ways a police officer can enter a home without a warrant, unfortunately i do not know all of them but I do know some. 1st say a police officer was walking by your window and saw someone shot and kill someone else, he caan go inside regardless. Another, say the police are pursuing a suspect on foot and the suspect runs through your home, the police can follow. Yet another would be if a police officer is told that an armed and dangerous suspect is inside your home about to commit a serious crime, the officer has the right to go inside. In New York state there are a total of 8 exceptions to the warrant rule, each state is different, and new york is very liberal, so you do the math. Unfortunatly we dont know the specifics on the officers intentions, but if he did nothing to you or your family i think it is safe to assume his intentions were not malitious. I hope that helps.

They cannot do that unless they are in pursuit of someone or they have a warrant. In some states if your door is open they are allowed to come in but they need to try to announce their presence by knocking or yelling inside, and they can only enter if they think someone is in danger.

You should call the police station and file a complaint. Tell them you want a written explaination of why the officer entered your home. Tell them if you are satisfied with the explanation you will take no further action, you are just asking for information.

Then you will at least get an explaination of the officer's actions. Then you can judge if you want to take the matter further.

Under specific conditions, police can enter your home. You said you were on the phone in the bedroom. It's very possible that the officer, after checking on the domestic abuse call down the street, thought to take a statement from their neighbors, including you. But, when he knocked on your door several times and you didn't answer, he had every reason to suspect that you were also at immediate risk.

This is very reasonable to presume, but it depends on whether this is how it played itself out. If an officer has plausable reason to suspect you're in immediate danger, he can break into your home to ensure that you're safe.

My best guess, to make sense out of this whole thing, is that the officer knocked several times very loud, but you either didn't hear it or decided not to respond.

They do whatever they want or can get away with...Look at the history of police and police actions through the centurys...most of them are bad. If your door is open , I believe they do not need a search warrant...That won't stop most though...just always watch what you say to them...be polite...they have extremely tiny brains...that's why they become police..Again...be careful..it's going to get worse...

they actually can't do that. You should call the Chief of Police and make a report of an unlawful entry. Why would they suspect that the person might be in your house? Just report him! Why do cops feel they are above the law? Why?
