taking the baby she thinks that he is just coming for a visit..neither parent has custody from everything i have read this is completely legal and there isnt anything she can do. The baby isnt in a safe enviroment so that is why he is getting his child.

my question is can he really do this? everything i have looked up points to yes but i just dont know.

the baby was born in texas and thats where he will be returning

It is legal as long as neither has custody, it happened to me. I think it's a horrible thing to do to someone though. I was heartbroken when it happened. He lives far away from the baby? How does he know for sure, has he witnessed this. I think this is a really crap way to do it. He should go to court and do it right because even though it's legal it will be illegal if he doesn't allow her to see the baby, trust me, like I said I lived through it. Of course this was in a different state, but I think your friend should go to court and do it the right way. I think the mother will be terrified and horribly saddened by this...is THIS the type of father he want's to be? Seems a little chicken **** to me but whatever.

Sounds like kidnapping. Read further because it seems that the child will be crossing state lines and then you are talking federal charges. Don't be to hasty to assist. I would say that the authorities should be contacted if the environment the child is in isn't safe and then take it from there, or maybe your friend should make application to the Court for custody or a review of the home where the child resides. There are other options better than jail time, please research them all.

Well if he didn't let her know he may have a problem since the baby lives with the mom,she can say that he kidnap her baby.and it is always up to the court to decide if the baby lives in an unsafe environment.Acting this way he may loose guard of the child if this case goes to court.

If he has not got custody, legal custody, he has no rights to take the child. He should notify the authorities so they can take the child away from her but it's nhot his place to, he can be held on all sorts of charges including kidnapping.

There are so many factors that we don't know about, it's almost impossible to say. If neither parent has custody, then who does?
