can they fly home without incident or detection thru the new US-VISIT
requirements

or does this not apply to them ,,...

Then when they reach home can they apply for a work visa

or will they be penalized ???

Been on planes lots since 9/11, and all they want is ID. If they have ID and can buy tickets, they will be allowed to get on a plane. They do not ask illegals if they are illegals when they are leaving the country, it the country that they land in problem to see that they are citizens of that country.
As for come back on an Airplane they would need proof that they are citizens of the U.S. (passport) or a visa issued by the U.S. to come in, or a travel visa issued by the U.S.
If none of these items are met, they would be returned to the place of origin.
