The US citizen has to file a petition for resident alien on behalf of the non-citizen spouse. Each case is considered differently and the evaluation is complex and aways changing.

It doesn´t matter what type of visa the non-citizen has, as long as they are in the country legally. The US citizen will file Form I-129 "Petition for Alien Fiance" on behalf of the non-citizen, which will take about 6-9 months for approval. The non-citizen will not have to return to his/her home country unless his/her current visa expires while waiting for the petition to be approved. If the non-citizen overstays his/her current visa the fiance petition will be denied.

are not getting MARRIED ON A VISA WAIVER till you prefer to gamble the two get married then the Brit returns homestead and the U. S. citizen documents for a spousal visa or dont get married yet and be conscious for a fiancee visa
