You can give the child anyone's last name. When you do do this though, remember, even with a paternity test proving other ways, the father on the certificate is responsible for the baby.
The baby should always take the name of the father, even if you are not married, and even if you are not together. The baby deserves the name of the father, even if the father is a piece of sh** to you. To your little one, the father is Daddy.

I'm not totally sure that I understand. But you can name your child anything that you want, first middle and last name. You could pick a last name at random from the phone book and give it to your child and it would be perfectly legal.

Hi most definately legal, me and my partner are not married and my sons have his last name,after all he is the dad and sending over a point to jmk on his answer,just because the mother and father are not married doesnt mean the child doesnt have 2 parents ,,duhh!! my kids are LOVED by us both weather we are MARRIED or not!!!

All Children are "legal" now so it does not matter what name the child has for its surname. There is not longer the stigma of illegitimacy on babies born out of wedlock.

yes he or she is legal i am divorced and my daughter has my boyfriends last name he is on her birth certificate it is your choice if you want to give the baby his last name my friend whose fiance was deployed to iraq while she was pregnant when he was killed in action she gave the baby the dead fathers last name i thought that was a great tribute.
