I know a couple who are first cousins n got married in the Philippines. The father of the woman and the mother of the man are brothers and sisters. The man is a naturalized US citizen, filed a petition of this cousin wife of hers and she arrived here in the US last month (Feb. 2007). The man's side of the family are all here in the US, and i believe that they got married only to bring the woman's side of the family here in the US. Do you think this marriage is real or a fraud?

Yes. First cousin marriages are legally recognized in the following states: Alabama, Alaska, California, Colorado, Connecticut, District of Columbia, Florida, Georgia, Hawaii, Maryland, Massachusetts, New Jersey, New Mexico, New York, North Carolina, Rhode Island, South Carolina, Tennessee, Texas, Vermont, Virginia, and under certain circumstances in Arizona, Illinois, Indiana, Maine, Utah, and Wisconsin.

Is it marriage fraud? It is impossible to say, but many people try to manipulate US immigration laws in order to get around the legislated requirements.

In NJ I believe it is legal for first cousins to marry but not second cousins, although it did surprise me when I found out. Given that it is legal in some states, I do not have a problem with the marriage as such. I would have a very big problem if it were a marriage of convenience. However, that is the job of USCIS and they do it, in my opinion, very well indeed.

I don't think so ,at least not in every state. It should be against the law all over the world,in my opinion .
It sounds like a fraud but may be hard to prove .

It depends on the state the couple resides in. First cousin marriage is legal in 26 of the US states, and marriage between second cousins and beyond is legal in all states.

In some states. However, we usually recognize heterosexual marriages that are legal in other countries. Exceptions might be for underage marriage.

Fraud is a separate issue.
