Your brother will more than likely receive Six penalty points, thus allowing the DVLA to revoke his licence.
The police may chose to prosecute your other brother for permitting the use of his car by someone who he knew was uninsured - again six points.
The police took his licence as, if he has it on him when they issue an endorsable (one you can get points for) Fixed Penalty Notice, they are required to.

Driving without insurance 6 points, driving without a full licence a further 6 points. In the UK if you have 6 points or more on a full licence within 12 months of getting the licence you are required to retake your test again.
I suspect in your brothers case he will receive a full 12 points and ban for up to 12 months. There is also the option of an additional fine of up to £600.00
The reason why the police took the licence from your brother was to ensure that he does not apply for a copy licence before the court proceedings Begin.

It's probably a six pointer plus a fine but the courts are clamping down on young drivers and especially those who do not have a full licence. He may recieve a years ban in a worst case scenario.
I'm not sure the police have the right to confiscate his provisional licence until the court date. I was banned from driving in the UK 5 years ago but I got to keep my licence from the time of the offence until I went to court, almost 1 year later.

My friend got caught for having no insurance a year or two ago. It went to magistrates court and she got six points on her licence and a £100 fine.
I think this is the standard penalty for things like that. But if it goes to court you dont have to attend it can be dealt with in your absence for these things.

I have always been under the impression that you are NOT allowed any points on a Provisional. It will be taken away from him and it will be a year before he can apply for another provisional.

I would imagine it would be a fine and points, probably 3 or 6 on his license. It generally only goes to court if you contest it.
Was he not covered by your brothers insurance, given he was driving with his consent?

i think my friend was in something similar.
went to court, licence gone for a year had to retake test and got fines for court proceedings etc.
unfortunately the licence company made a mistake and when she re-applied to get licence to re-take test they sent her a copy of her licence. she carried on driving and never got punished properly.
im disgusted the court was rubbish and police worse for not checking!!!

6-8 points and a max fine of £1000 - but it will be probably be within the range of £200-£500
But it should be the maximum of £1000 for your idiot of a brother.

If its his provisional he's lost it already. U only get 6 points on a provisional and he's lost them. Its gonn a be harder to get another one now as well
