I don't know about austrailia, but in the US you cannot have an open bottle of alcohol ANYWHERE in the car. You can transport alcohol UNOPENED in the BACK SEAT out of the reach of the driver, but you absolutely cannot have ANY form of open bottled alcohol ANYWHERE in the car. Not even in the back seat, not even the passanger.

No idea about Australia but it seems so in the states as from what I am reading. In South Africa however its not illegal for the passenger to be on their cell phone or driving with open bottles of alcohol. It is however the drivers responsibility to make sure that his passenger next to him is wearing his seat belt as the driver will get fined for that.

truthfully, it relies upon on the state you're in. In long island we've an "open field regulation" that makes it unlawful to transport an open alcoholic beverage in a motor vehicle. the driving force could be ticketed for permitting the field to be open of their motor vehicle. The passenger could be ticketed besides, for an identical offense. The alcohol could be dumped out. in the journey that your state does not have an open field regulation (some do no longer) then there could be different fees that prepare (public intoxication, and so on) even though it may be criminal to have a drink on the motor vehicle. by using fact the driving force is responsible for each little thing in the motor vehicle, if the driving force is a minor, they could be charged with minor in possession.

(In the US) it is legal for you to be a passenger with an open container of alcohol, but it is not legal for anyone to be driving while you have it. In other words, you won't necessarily be in trouble, but the driver will be.
