child has lived with grandparents all his life he is 10 mother has been gone since she handed him over and the grandparents dont want the father around because they lie to the child that his father is no good and denied support from the father but wont get full custody of the child because they want to right him off on taxes and get government help.how do you get them to get custody because they will never give the child back and will never let the father spend time with him what do you do

This is the 3rd question I’ve answered from you tonight about this issue, but your other 2 questions were about parental rights. Now you’re asking about custodial rights. It’s important to understand that they are entirely different things.

It makes no sense that the grandparents would not want custody because "they want to right him off on taxes and get government help". They can STILL do those things if they have custody (although I don’t know what kind of ‘help’ they’re receiving, and that *might* make a difference).

Dad can’t MAKE the grandparents take custody. Although I’m wondering how in the world they managed to do things like enroll the child in school without having custody.

And Dad can’t just walk away from his child (which based on all the questions, it seems like that’s what he’s wanting to do).

What Dad can do is get his rear down to the courthouse and petition for visitation or the return the child, whichever one he wants.

Of course, the grandparents can turn around and file a request for retro-active child support…which they may or may not get. Yes, I know they ‘refused’ his money, but he still had an obligation to support his child, and if they refused the money, he should have been depositing the money into a bank account for the child.

But how is it that the grandparents received government help and the state did not seek child support from Dad? Is he the LEGAL father of the child?

Not an easy task here. You will have to first petition the courts for a custody hearing, this is the easy part. The real hard part is going to prove the mom and dad unfit to be parents. This will have to be hard concrete evidence and not hearsay or feelings or what anyone thinks. Child abuse, drug abuse, mental illness are th usual reasons for being unfit. Then you will have to prove that either parent will be an endangerment to the kids. The courts will take the best interest of the children into consideration above all rest and rule from there. Thats exactly what youre going to have to prove, that living with either parent is not in the best interest of the children. Not easily done. Good luck

wow, that seems extreme. I propose once you've complete custody, lower than the regulation she is meant to be with you. And what you stated, that i found important IS the count number number of believe. Do you've self belief in her grandparents or father? i imagine so you might really imagine this by, having her grandparents in her existence or no longer can really impression her. solid success.

The first thing is there great grandparents They need to go talk to a lawyer and he will point them the right way. good luck

i would contact child services since in most cases unless there is a court order the grandparents can not keep the father away... take them to court....
