My girlfriend has just moved here on a tourist visa for 90 days and we would like be able to have her stay longer and perhaps get married. When she entered the country the Customs People interviewed her for 3 hours and told her that if she and I were going to try to get married while she was here that they would send her back now.

We might like to do this or at least extend her stay as well as be able to make it so she could work while she was here. We thought we could extend her visa by going to Canada for a weekend as we live in Seattle and this would be easy to do. We now are afraid that they would not let her back in as she has already been maybe black listed from her first entry.

Any suggestions on a way we could extend her stay and perhaps being able to work while she is here would be helpful.

If you could suggest websites for research on this that would be great too, anything would be helpful.

She is from Sweden and the last I checked the US has always liked them.

Don't get married in the US while your girlfriend is on a tourist visa, I have friends who did this and it turned into a huge headache for them. She will need to go back at the end of her visa, but then you have 2 options...

1. obtain a fiance visa and get married here.
2. get married in sweden and then arrange for her greencard at the US embassy in Stockholm.

I personally did the second and it worked out really well - everything was straightforward and we didn't even need to get a lawyer. Because sweden has fewer people to deal w/ than the US, things moved really quickly. We got married one day, went to the embassy the next day and about 2 months later, we were all set. From what I've heard, getting a fiance visa can take much longer b/c it goes through the US system instead of the Swedish system.

The US 'liking' Sweden has nothing to do with immigration law.

Since your girlfriend entered the US on the visa waiver, she cannot extend her stay beyond 90 days; that's part of the country-to-country agreement. She also agreed to it when she signed the I-94W form before she arrived.

CBP might not let her back in - after all, she is not a tourist, is she? She intends to stay longer than 90 days, marry you and to work, all of which are not allowed on the visa waiver. Ignoring and breaking immigration law is not the best way to get started in the US.

She needs, at least, a fiance visa:

Don't take risks. She should stay in the US for the time she was allowed. Then she should go back to her country. And if you two decide to get married, she can enter the USA legally and for the purpose of marriage. You will have to ask for a fiance visa for her.
The things that you mentioned are not right, If you love her, you would not want her to be an illegal alien.
Do it legally.

Whats extra important residing there or with the guy you adore or residing in France. i understand i could like to move to a unique state, yet my husband does no longer opt for to even evaluate transferring. Like your husband my husband is a surprising guy too, so I chosen him.

call an immigration lawyer. they would be able to answer all your questions. good luck.
