I received ticket last August for not having valid tabs. I got my tabs right away after the ticket. I was late paying the ticket and received notification that if I did not pay by a certain date I may incur additional finds/ have my lcense suspended. Over the weekend I got stopped and received a citation for driving after suspended. I received no further notification confirming I was suspended and I did pay my fine. I have proof of payment for tabs and the fine. My insurance agent confirmed they were also not notified of the suspension and had they been, my insurance would have been canceled. Does it sound like I will be able to contest this? I do not want to pay to re-instate because that is a plea of guilt and I have an appointment at the DMV tomorrow...

If your license was suspended due to failure to pay your ticket on time, you will most likely have to pay a reinstatement fee anyway. The state fulfilled it's obligation when it sent you the first notification. Most states don't contact insurance companies (it's their responsibilty to check with the state's database). I hate to say it, but you'll probably have to bite the bullet and pay the additional fees.

Go to your court date and take all of your receipts with you. When you explain the whole thing to the judge and show him everything including the letter you received and the fact that the fine was paid before the date on the letter, then the judge should rescind the suspension. . I used to go to traffic court for giggles back in my younger days and I have seen that happen many times. Not to worry, if you have all your paperwork in order it should all be taken care of that day.

Get a letter from the insurance company stating that they never received notice of the suspension and bring your receipt with you to the DMV. That should be enough to get your license back on track and you shouldn't have to pay any fines or fees to reinstate your license since it was a DMV clerical error.

Yes, you can contest the DAS. Bring in all proof you have...receipt for the valid tabs and the ticket fine.

Many times, data is not caught up in court computers. You should ALWAYS keep receipts for any petty tickets you pay for several years.

They should rescind the citation after everything gets sorted out. If not, hire a lawyer to threaten them with a lawsuit, that usually works.
