Does he have to file a tax return? what form should he use. he lives with us.

As long as you provided more than half of his support you can claim him as a dependent.

He only needs to file a return if he had income taxes withheld and he wants to have those refunded. He can probalby file Form 1040EZ if his only income was from wages reported on Form W-2.

Since your son's income is well below the minimum, he does not have to file a tax return unless he owes taxes. However, he cannot get a refund if he does not file a tax return.

While the tax form he files depends on his circumstances, in most cases the 1040EZ will do. Of course, your son cannot claim himself as a dependent since you already claim him, so his dependent exemptions would be zero.

I think the minimum before you HAVE to file is 11K. although he CAN file a return if he choses, and you can also claim him a dependent. It just affects what he'd get back etc..if someone else is claiming him dependent etc..
