My little girl will be 3 on saturday, her father has never really been in her life. He has seen her about 10 times since she was born. He promises her things and doesnt do them. She is at the age that she remembers everything. Anyway my question is can i get child support from him since he is illegal? If so will he have visitation rights even though he has never cared to be in her life???

OK....LOOK...i am not stupid and got pregnant without knowing who he was/is.....i know everything there is to know about him and his family....plus its been 3 yrs i dont want him back...and i am closer to his brothers and sister in laws than he is.

yeah you can get child support as long as he is the father and you guys arent together. and yes he would get vistitation but he wont necessarily take it.the way i see it is he could sign off all rights since he doesnt take care of her anyway but that would be too easy for him. take him for everything hes got. he helped make her he can help take care of her or at least pay for her expenses.

So what did this guy do to make you think he's telling you the truth about anything?
He does't have much of a good record on anything so far. A girl he didn't marry, a child he doesn't acknowledge, a country he doesn't belong in.
You need to get in touch with the child support people in your local courthouse. Call the city hall and ask the clerk there for the number to the child support division.
They will have you come in and interview you for information to get a DNA to prove that he is the father. Get that taken care of and if he proves to be the father, then they will proceed to file against him for support.
Whether he is here illegally is not your business at this point as he may or probably did, lie to you. It will be for the court to find out. This will protect you because you will not be blamed for his misfortune if he really is illegal.
Don't expect this baby business to get you back together with the loser. He probably has a wife and kids back in whatever country he came from, so don't be surprised when that comes to light.
Its up to you whether you want to file for the support, which you might get a piddling little amount... or if you just want to forget it and take care of the bills yourself and have the peace of mind that your freedom allows you.. to move whereever you want and have your child all to yourself. The choice is yours and you will have to live with that choice forever, and so will the child.
You may however, not have any problems with him since if he has to actually pay child support, he may just disappear on his own. Good Luck and kiss the baby for all the grandmas in the world.

You can try. Most bums won't bother to pay. And I wouldn't worry about visitation rights - I don't think he'll bother; he's too lazy to care or make the effort. And regarding visitation rights - they are considered a separate legal issue. Check with an attorney or call up one of those child support enforcement groups. You must - not for you, but for the sake of the child. You are the only one she has to rely upon.

each state is different but they all agree a mom or dad must pay support for their children.it does not matter if he is a citizen or not no free ride on this anyway.and yes he will have visitation rights in almost any case unless he is a child molester rapist or a convicted felon.even then he may be allowed supervised visitation any way even if he never pays child support.the friend of the court sets the amount and will put in a order to his employer to pay whatever it is according to his pay scedule.good luck.

If he is not a legally documented worker in the U.S. you can not garnish his wages most likely. You can check with your state district attorney's office about setting up a garnishment on his wages, but you'll have to get an attorney first and get a wage order in place to make him pay support. If he's working under the table for an employer who does not report him or his wages (day labor or cash only) then you can't get it garnished. It's worth a try.

Well, there's your problem right there. Her daddy is an illegal immigrant. You pick her daddy, she didn't. Sound like to me you got some explaining to do to your daughter because like I said that's your daughter until the day you die. I don't think U.S. going to make him a citizen because he got you pregnant. You should have done some investigation before you got pregnant by an illegal immigrant. That sh*t felt good that's all you thought about at the moment. Oops!!! I'm pregnant but he's an immigrant. What do I do? Nothing, raise your child.

I'm not sure about the first part - but if you get child support from him - they usually set up visitation rights at the same time.

I would definitely contact your atty. Most will do a free consultation.

u can attempt to go get child support from him.. although he may jus go back to where he came from.. and sometimes n some cases he can have vistation but seems like to me he doesnt even care about the child or nethang to that matter... but hell yea take him to court u can get child support from him! My friends baby's daddy is illegal and she got child support from him! if u care about ur child u will go attempt to get child support specialy since ur child is starting to remeber the things her father is telling her and promising her! good luck

If he is working here in the states, you should be able to file for Child Support through your state's DHS.

If he is working, the state will garnish his paycheck & send the calculated child support amount to you each time he gets paid.

No offense, but he doesn't sound like the kinda guy that is into the whole "following the law and paying child support" thing.
