I recently recieved a DUI (two actually) one for state and one for local ordinance for sleeping in my car while intoxicated. The car never moved (i have three parking tickets to show that ;-) and i had a designated driver who was still in the bar.

The prosecutor will not reduce the crime to a lesser offense (since the car had not moved and was not moving when i was pulled from it). What can i do?

Not sure about Georgia. I know in Jersey if the keys are in the ignition they can get you for DWI. So if you happen to be sleeping one off while listening to the radio your sh#t out of luck. Good luck man. This totally sucks. You're trying to do the right thing and they still have to mess with you.

It is presumed that if you are in a car when intoxicated that you had to drive the car to get it where you were found.
If your designated driver was not present at the time of your
encounter with the police,it is hard to convince them that you have one.
If you were sitting behind the wheel while sleeping it adds to your guilty look.
At best,if you have witnesses that can attest to your designated driver along with your designated driver,you MIGHT get your charge reduced to public intox.
In the future,put the keys under the seat and sleep in the back seat. . . best they could get you for then could be trespassing or vagrancy.

If you were in your vehicle while intoxicated and had the keys in your immediate presence, it is DUI. If you have a good lawyer, you might get away with a slap on the wrist, good luck! and next time be ultra polite and hide the keys!

If you were in the car, and in possession of the car keys, and drunk, yep that is all they need in GA for a conviction.

Hire an attorney, ( a GOOD ONE)

If you are in a vehicle and have access to the keys to its ignition; it is an automatic DWI/DUI.....

Were your keys in the ignition? If so...sorry, thats where they get you. If not, then you may have a case.
