*my mom parked in one along time ago, nothing happend, nobody knew that we did, and we didn't notice we had, until we left the shopping center, there was no sign, and the paint on the ground wasn't very visiable.

If your vehicle is spotted in a handicap stall, it can be ticketed or impounded. If it wasn't marked properly, you can take pictures and show them to a judge, who will decide on wether or not to reduce or dismiss the fine. Parking in a handicapped spot in California generally gets your car towed, a $276 ticket, or both.

I just watched them tow a car from a spot that whose sign was a few inches too low. It was high enough to be seen by anyone who has enough vision to be able to safely operate a motor vehicle. So, you can be towed. The officer chose not to add insult to injury and ticket the car but he was well within his legal rights. You can pay the impound and tow fees, recover your car and take the ticket to court with evidence and fight it. But honestly if you can see any part of the marking they can chalk that up to wear and tear and charge you whatever the minimum fine is up to the maximum fine.

And, if there is karma in the world at some point you or your mother may likely need the assistance of closer parking due to poor health or a general healthy dose of karma. At which point someone will probably be parked there illegally claiming ignorance and cause you similar distress as the distress you likely caused someone else.

I parked in the "perfect spot". I looked for a handicapped sign, none was there.

Well, it was painted on the ground, but covered with snow! Apparently, I was supposed to just know that this spot was a handicapped spot. I got a ticket. Lucky me.

It really depends on the judge you have that day. If you have a judge that see's things for what there worth they may throw it out of court. But, be sure to have evidence. If you have a judge or a police officer having a bad day, and you live in the state of IL you can be fined up to $500.

It should be up to the facility that controls the parking areas to be sure these spots are clearly marked. As, they too should recieve fines for lack of.

You can get in just as much trouble as if it were completely normally marked. This is what I was told by a judge after my car was towed for being parked in a red zone that had completely rubbed off! Not that I thought it was fair...

You just get fined. If they are nice, it will only be 20 bucks for improper parking. If not, they can get you with 200-300 dollars for parking in a handicap spot. (The actual amounts will probably vary by state.)

if you can prove that it is not properly marked then, depending on the judge you may not get into any trouble. photos of bad paint, damaged/covered signs etc should help make your case.

if u get caught you get fined and maybe your car taken away but if u dont you kno in your mind that some one that really needs that spot had to go somewhere else because you wanted to get in the store faster.

Whether it's "properly marked" or not is really not an excuse. Sorry. Handicap spaces are fairly distinct in layout, markings, and proximity to an establishment. Just give a bit more consideration for one who may really need it and park a few spots down, the exercise is good for us. :)

A big buck ticket. I got one outside city hall, dumb me. I am an old lady with a bad hip and no disabled placard. The fine was 350USD and it was dismissed after two letters, to the PD and the court. If you are a kid you'll get nailed. The not-properly-marked defense may not be an excuse for you.
