I am considering filling for Bankruptcy but I am married.
If I file for it, my spouse has to file to so he won't be stuck
with the bills?

Please only respond if you know for sure, just your opinion is not going to help me. Thanks in advance.

Your husband does not have to file, but he will be responsible for any bills that are in both of your names. It will also show up on your redit report for 10 years, but that does not mean that you will not be able to get credit of future loans. You will get offers but the interest rates will be much higher.

You really should talk to a financial consultant, like a certified financial planner, a CPA, or tax attorney, before filing for bankruptcy. If you do file, you will do serious damage to both yours and your spouse's credit rating for several years after the fact.

It doesn't matter who files for bankruptcy if the bills are in both your names.

Quite honestly there is no single answer to your question. The best thing to do is to meet with an attorney in your area and get his advice. If your spouse is listed on the account, then more than likely the creditor will go after him. If not, then probably not - but there are exceptions. Many attorney's offer free initial consultations. They are your best resource.

It all depends on what you are delaring for discharge. If the bills youare entering are in just your name then yes you can file alone. If its both of your then you both have to. But know this, you are married and whatever you go for in the future will hae your bankruptcy on it. See if you can first go to a credit counselor.

If you have joint accounts that you are going to include in your bankruptcy? The lenders will go after your husband if he doe's not file also.

If you have joint accounts? And your husband doe's not file, they will show on your husbands credit report as "Included in bankruptcy of another person". This will show for 10-years.

If the accounts are in your name only? Then he will be in the clear.
