my ex boyfriend got a letter from the IRS stating that they are reviewing him and he has to pass 9 tests so that they can give him the money that has been withheld. He has a child with a married woman and decided to claim her. The problem is that he doesn't appear on the birth certificate or anything as the father. He hasn't even given the mother any money to help out. To make things worse the husband doesn;t know. Out of all the test's he has to pass he only can pass one. Will the IRS penalize him for putting a wrong statement. will his taxes be reviewed again... Does anyone have any suggestions to what he can do?????

Unless he has custody of the child he cannot claim the child as his dependent unless the mother gave him written permission to do so.

Wherever he got the idea that he was entitled to the exemption claim escapes me; he certainly didn't read the instructions before he prepared his tax return.

He must file an amended return by April 17, 2007 and pay any tax due to avoid penalties and interest from the IRS.

If he claimed the EITC based upon this dependency claim he'll lose his right to claim the EITC for 10 years due to the fraudulent claim. And any dependency claims on any tax returns he files for the next 10 years will be closely scrutinized by the IRS.

Good thing for you that he's an ex. Not what I'd call sterling husband material, what with cheating on his taxes and not supporting his children...

Why in the world would he have thought that he had the right to claim this child?

At a minimum, he'll have to pay back any extra taxes that are due for having claimed her. He might also be penalized.

If he hasn't gotten any money refunded yet due to this bogus claim, he might get lucky and just have them disallow it and refigure his taxes without the child as a dependent.

The husband probably knows now - since presumably they also claimed the child, they would also have gotten a letter asking them to prove their claim - I assume he'd ask a few questions of his wife as to what this is all about.

Sounds as if he claimed a child that wasn't rightfully his. Be prepared if you've already received your refund to pay back the extra money he received along with penalties and fines(as he should) if you have not received a refund yet the IRS should fix and send the amount he was supposed to get.

He needs to take a blood test to see if it is his kid..Then he can care of his taxes.
