It fell off the pole though Into her garden. Now she's being unreasonable and won't give it back. what should i do?

I would check out local ordinances. In California, this is a taboo to photo anyone who is in a private place with a reasonable expectation of privacy. It will put you in jail, and the evidence she is holding would be quite compelling. That is what the fence was for in the first place.
Other states may be more permissive or have lower penalties so you might get lucky with just losing the camera.
Now had you asked permission first, you might have gotten more than just pictures.

I'm sure that what you did was an invasion of privacy and she could probably report the incident to the authorities. In which case she should keep the camera as part of her case.
What you should do is apologise for being a peeping tom and promise never to do that again.
Then the two of you can discuss returning your camera (I think she should keep a copy of any footage of her that was taken and erase it from the camera before she gives it back).

Well, you could report it to the police, but you'll have to explain what you were doing which could land you in more trouble than a lost video camera.

Be very, very grateful that she didn't call the police. Let it rest a while, apologize, and promise not to do it again and maybe you can get it back..
