In California a woman was beat up and her child abducted from her own home. Because it was the father and he left no markable evidence on her body (shoved and backhanded her), the police did nothing. There was no custody order on file. The man is a previous abuser with a record of serving in jail for abuse.
He took the child and hid out, filed papers behind her back with a different case number after she filed a petition for emergency custody of the child. He never served her and won a default custody case, while there was another case pending in mediation.
He then frauded over the womans bank accounts and credit until she needed a new social security number, and violated restraining orders but never charged. He is now concealing the child in an abusive enviorment and is trying to obtian child support while threatening her life making her flee across the country for her own safety.
Should she have to give this man child support, and is there anything she can do. He's in CA - She NY

It's a true story. Anything is possible.
She is literally terrified of this man and going to back to CA. It started April 2005. She left him for a man who came to help her out from NY who I know personally he is a good friend of mine. She was beat up for speaking to him online and he couldn't take knowing it and flew out there to help. When her ex found out he beat her up and kidnapped their son who was 4 at the time.
Her son witnessed her being beat up plenty of times and still remembers it all to this day. The father is a Satanic sicko who is using her child against her.
Because he stole her money and ruined her credit she can't get an attorney. Not to mention his entire family is friends with their local police department and has a lot of money and good legal counsel.
She got married in Oct 05 to the man who rescued her and they have a 7 month old together. She is too afraid to be in CA for her 7 month olds life. Her ex threatens to kidnap and kill her baby.

They were not married.
They met when she was 15 and he was 21. The relationship ended when she was 22. She got pregnant at 16 and he was 22/23 at the time. He signed the birth certificate, but she is unsure if he is even the real father to the child.
She was cheating on him and he found out. He beat her up and raped her and she got pregnant. Her parents forced them to be together. Her father was dying of cancer and had this man take care of her. She was abused for so long and so was her son. Her son is still being abused to this day.
She had him in October this year and had to rush him to the ER for a gash on his head that the boy got while in his fathers care. Her ex threatend her life if she didn't return him. He was allowing for 1 hour visits in the park. She was pregnant so she took the visits.
In October her baby was 2 months old so she gave her older son back to keep her and the baby safe. He then told her he was going to have her and her baby killed. So she came here.

She was working with a small advocacy group who helped her get a restraining order. The group only filled out papers. The judge sent them back to mediation, which is where mediation found out about this second case.
In response to the restraining order her ex said her husband was a murderer to try to get him restrained but it was denied. Then he tried to motion for no visitiation because her mother was a smoker and it was denied. Each was a new case.
The judge compiled the cases together sick of having so many cases to look at and told her ex not to continue to make new cases but file under the original. The mediators, his lawyer he obtained in May 06 stipulated these 1 hr visits. Just to see her son she agreed to them she had pre-eclampsia and was supposed to be on bedrest anyways.
There are no free attorneys in the Bay Area where this case is being held. She needs serious help and so does this child. She's reported it to CPS a millions times over, and the police -- thats a joke.

He opened a support case in another county different from the custody case and did the entire default service. He wrote her address down and had someone serve another address and not her. So she never got the chance to speak in court. He has a pattern of frauding over the court system and getting away with it.
He knows by her banks, mail forwards, and his lovely highway patrol and police buddies her general location at all times. So because he knows her husbands previous address in NY (he was a room-mate) I was sent a packet by the local social services here with her name on it. Along with that I am being sent death threats and he has death threats posted all over his internet profiles. Including bloody poetry on how he is going to murder her, her husband, and her infant.
She was given a secret address program in CA but due to his sources he always knew where she was at and was always threatening her via email and phone.

She has PROOF UP THE YINGYANG of the fraud. He put his address on her credit file, that he was her spouse, he uses her as a spouse on his credit applications AND he used her social and made fake paystubs saying he worked for her to obtain a car loan and had someone call saying that they were her to verify it.
She took it to social security and they gave her a new social immediatly. This man kept her social, her IDs, her money, and controlled her for years.
Social security said they are investigating it and that's it. It's not social security she needs to worry about it's her son not the distraction tactics like credit fraud and abuse -- but it does show a paper trail of the actual credit and court fraud which can prove his character somehow.
The irony the attorney he hired used to be her father's attorney in a child custody and support case against her mother when she was a minor. So the attorney is vindictive because her mother's attorney won.

Start with investigation of California law concerning parental abduction... it is still a crime, if done prior to any custody proceedings. The dept of justice puts out an excellent publication re family abduction, but particularly the fact that many professionals STILL DON'T GET THAT IT IS NOT A CUSTODY OR PRIVATE DISPUTE.
The police failure to take action is a cause for investigation of that department. His leaving marks or no marks has nothing to do with taking the child against her knowledge or her consent.
GET the documents that show he filed a petition contrary to the original emergency petition, and that there was a pending case that should have had jurisdiction. I suspect that you may not have proof that he messed up her bank and credit accounts.
No court CAN be aware that fraud happened... unless mom is willing to make it clear to them. She HAS to have the proof of fraud, and she has to find a way to file the petition to have the rulings vacated.
I have no doubt of the pattern of this story... I watched almost the same happen to a family member. And it continues because she is waiting for "when she gets enough money" for a lawyer. No lawyer can help someone, unless they research enough to understand that fraud is a crime.

He's stupid to be in California. California doesn't take this behavior lightly. The said person should get a lawyer. That would answer all the questions. THe lawyer would prove that he did not serve her properly, and undo the damages it caused. THe lawyer would probably take the case to the judge of the original custody case. SHe souldn't have left to New York. She should have stayed in California and hid her location for a while. Have a third party handle the mail. THe father might make claims that she is purposefully hiding. She can't get her Child back when she runs. THere are support groups for battered wives. THey may help with this case. At least they may know people who went through similar things and give appropriate suggestions.
Edit. Thats how these men work, by creating fear. You might report him to Child services. THink carefully, because the alternative might be foster parents. If she's poor, she might get a free lawyer, but I don't remember how to find one. THe Battered wife support groups might know. I think there are pamphlets in the court house.They're not that good, but the abuse is clear cut.

File a case for the custody of the child in New York and enumerate all the irregularities committed against the wife. Request the all cases favoring the husband be annulled on grounds of fraud and harassment so that the court will rule in favor of the wife.

If the judge ordered her to pay child support then she must pay until she gets a stay on that order, or another judge over-rules it.
They will track her down and jail her if she doesn't pay and this will reflect poorly on her side of the case in the future. She should continue her case in the meantime.

is there some reason why someone has not reported this to the District Attorney (of the org court), states Attorney General, Governor, Dept of Justice, Judical comittee's, etc.
i hope someone reported this bas****, AND the judge, AND the attorney to the state Bar Assoc.
oh that poor kid. poor woman. what a sad story; a control freak, criminal and he got the child by default.
i dont know how to help, other then telling her that she needs to write ONE letter to all of them, reporting the illegal situation (short letters are more effective) to ALL STATE and FEDERAL agencies, committees, abuse orgs, child advocates, etc. ONE LETTER address to all of them; separate letters just add to the confusion. ALWAYS FAX IT; FAXED over and over again weekly. phone calls are useless, mail gets lost but FAXES are effective. its proof it was sent, they are aware of it, and proof they recieved it.
fax numbers are almost always listed online; if not, just call and ask for the fax number.
