i know the social security administration does not recognize a marriage until it is 9 months old or more...is the same true with the state..in so far as an open probate by the deceased wives husband?

I think it depends on the state. Nevada and California recognize it the date of the marriage. Probate happens three to four weeks after the death I think?? You should probably contact your family's lawyer or who is handling the probate to find out what they say.

social security will recognize the marriage from the date of the marriage if you have documents... so will the state

What do you mean about the SSA? I changed my SS card within a week of being married?
