You have to have the gold membership if you want to play against other people.

You should be able to connect to XBL silver just by turning on the 360 without any games inside the disk tray, provided you have an internet connection and you set up the connection correctly.

yes in order to play online you have to have gold, silver only allows you to play the arcade games and so forth.
