Maybe they were concerned with the fact that it shouldn't be a constutional issue. That it should be left up to Congress to make those limits.

It is a free speech issue. Does limiting the amount a group spends on ads limit their right to free speech?

Because there's nothing in the First Amendment which limits one's free speech to a particular dollar limit.

In short, because the constitution guarantees the right of individuals to get together and spend their money to say what they want to say.

So, any restrictions on people being able to purchase advertising need to be absolutely necessary to the fairness of the political process, and the least restrictive means possible.

Hence, the soft-money loophole to campaign funding laws.
