My husband took dylantin for almost 30yrs. through the VA.
The side effects caused the nerves in his hand to close up. Eventually, it will close all the way.

You should probably sue the makers of Dylantin instead of the VA.

No, you cannot sue the government for the following reason?

If I was an attorney, my questions to you would be: Did the Government force your husband to join the military? When did your husband start taking Dilantin? so in those 30 years, the doctor told you nothing about the side effects or you did no research on the side effects? If you did research on the side effects, then why did you take Dilantin and if you didn't do any research, then why did you take dilantin? What you need to do and you will most likely lose, but you need to research Dilantin and see if this was a side effect 30 years ago.

You can sue anyone or anything, provided you have a lawyer willing to take on the US government, and if you have virtually unlimited funds to pay this lawyer. I am very sorry about your husband, but sweetie, there are LOTS of veterans MUCH worse off than him. File for disability through your state and/or VA, and forget about a lawsuit.

You should ask your local Congressman.
