That will depend solely on where you live and where you want to open the restaurant. You will need to check with your local city hall, or whoever takes care of those issues where you live. You are wise in trying to find out early, but you need to find out at the local level, where you live.

Just call on the next business day, and ask. Make sure you have all of your questions written down before you call, so you aren't fumbling around. Be sure to find out everything about what you need in order to be a restaurant owner and what you need to do about hiring employees, insurance, wages etc.

I live in a small town with a population of about 3,500 and shrinking and I was told I needed to get a small business license just to run my Internet business out of my house. I find that most towns, cities etc are pretty strict about licensing, so do your due diligence and get all of the info you need in advance.

You should do fine.
