One provision was declared unconstitution, back in 2003-04.
But the vast majority of the Patriot Act doesn't even deal with spying or survielleance. I just re-organzies internal govt operations and handles some unrelated matters, such as setting up relief funds for families of terrorist victims.
There are a few troubling provisions of the Patriot Act, such as the part the removes the restrictions on when and how National Security Letters can be issued. But those only target information that is already available to third-parties, so is not considered "private" within the meaning of the 4th Amend.
While some parts of the Patriot Act are intrusive or nasty, they are not unconsitutional. Barely not. But not.
As for the Real ID act, it can be repealed at any time by Congress. So can provisions of the Patriot Act. Congress just has no reason to, becuase most people are happy giving up control over their lives for the illusion of conformity.

Republicans don't care about the Constitution, that is fact. There is ample evidence to support that as fact. They have never cared about the Constitution. Republicans also hate the Bill of rights. That is also fact.
We now have 3234 dead service members in Iraq and the cost of that occupation will be $2 trillion over ten years.
These war dead last week are the responsibility of the Democrats who control Congress. They were voted in to end the occupation of Iraq and they have failed at the task given them by the American people last November. The price is high for 5 months of failure.
